1. Introduction

Welcome to BetBooks, a Software-as-a-Service (SaaS) platform that provides ERP functionalities specifically designed for OPAP retail businesses. These Terms of Service (“Terms”) constitute a binding legal agreement between you (“User”) and Maria Savvidi (“Provider”). By registering for, accessing, or using BetBooks, you agree to these Terms.

1A. Business Use Only

BetBooks is provided exclusively for use by businesses and professionals. It is not intended for consumers or private individuals within the meaning of applicable EU and German law (§13 BGB).

By registering for and using BetBooks, you represent and warrant that:

• You are a legally registered business or authorized representative of one;
• You are using the Service solely for business purposes;
• You have provided accurate business identification information (including your VAT number, where applicable).

The Provider may request verification of business status and may suspend or terminate accounts that do not meet these requirements.

As BetBooks is provided only to businesses (B2B), consumer rights — including the right of withdrawal under EU Directive 2011/83/EU — do not apply.

2. Description of the Service

BetBooks enables OPAP retail business owners to manage income and expenses, human resources, and lottery ticket inventory through a cloud-based ERP platform.

3. Account Registration and Access

• Users must register for an account to access BetBooks.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree that all registration information you provide is accurate and up to date.
• BetBooks is intended for business (B2B) use only.

4. Free Trial and Subscriptions

• New users receive a 14-day free trial with full access to all features.
• After the trial, continued access requires a paid subscription:
  • Monthly Plan: €30/month (VAT excluded)
  • Yearly Plan: €300/year (VAT excluded), payable in advance
• Subscriptions automatically renew at the end of each billing period unless cancelled.
• You may cancel before the trial ends to avoid automatic billing.

5. VAT and Invoicing

• As the provider is based in Germany and clients are Greek businesses, under EU rules (Directive 2006/112/EC), no VAT is charged under the reverse charge mechanism if the client has a valid Greek VAT number.
• Customers are responsible for declaring and paying VAT in their own country if required.
• Invoices are issued electronically upon successful payment.

6. Use of the Service

You are granted a limited, non-exclusive, non-transferable license to use BetBooks for internal business operations.

You may not:

• Copy, modify, or distribute BetBooks or any part thereof;
• Use the Service for unlawful or fraudulent activities;
• Reverse engineer or attempt to extract source code;
• Allow unauthorized third parties to access your account.

7. Data Ownership and Privacy

• You retain full ownership of all data you input into BetBooks (“Customer Data”).
• We process Customer Data only to provide and maintain the Service.
• We comply with the EU General Data Protection Regulation (GDPR).

8. Service Availability and Maintenance

• We aim to ensure continuous availability of BetBooks but do not guarantee uninterrupted service.
• Maintenance or upgrades may cause temporary downtime; where possible, users will be notified in advance.
• The Provider shall not be liable for unavailability caused by circumstances beyond reasonable control (e.g., internet outages, force majeure).

9. Termination

• You may terminate your subscription at any time via your account.
• The Provider may suspend or terminate access if:
  • You breach these Terms;
  • Payment is overdue; or
  • Required by law.
• Upon termination, your data will remain accessible for 30 days for export before permanent deletion.

10. Intellectual Property

All intellectual property rights in BetBooks, including software, design, trademarks, and content, remain the exclusive property of Maria Savvidi. Nothing in these Terms transfers ownership rights to you.

11. Limitation of Liability

• BetBooks is provided “as is” without warranties of any kind.
• The Provider’s liability is limited to the total amount paid by the Customer during the 12 months preceding the claim.
• The Provider shall not be liable for indirect, incidental, or consequential damages, including loss of profit or data.

12. Governing Law and Jurisdiction

• These Terms are governed by the laws of Germany, without regard to conflict of law principles.
• The courts of Cologne, Germany have exclusive jurisdiction over disputes arising under these Terms.

13. Amendments

We may modify these Terms from time to time. Updated Terms will be communicated via the platform or email and take effect upon publication. Continued use after changes constitutes acceptance of the new Terms.
